One Signature Divorce NYC: Step-by-Step
Our One Signature Divorce NYC service lets you finalize an uncontested divorce even if your spouse won’t sign, with clear steps and flat-rate pricing.
Step 1: Court Index Number Issued
When your case is filed, the court assigns an index number. At that point, we prepare an Affirmation of Service Form on your behalf. This document is included in our affordable divorce package—there are no extra fees for this step.
Step 2: Serving Your Spouse
To continue, your spouse must be formally served with divorce papers. You may hire any licensed process server you choose, or, if you prefer, our office can arrange a reliable and independent process serving company. We The People will arrange for in state and out-of-state process servers for $200.
Step 3: Affirmation of Service Completed
After delivery, the process server signs the Affirmation of Service confirming that your spouse was properly served. This form is essential for moving the divorce forward in court.
Step 4: Waiting Period – One Signature Divorce
If your spouse does not respond within 40 days of being served, you are free to move forward without their participation. At that point, you simply sign the remaining divorce documents. The court will process your uncontested divorce with only one signature—yours.
Step 5: If Your Spouse Contests
If your spouse does respond, hires a lawyer, or contests the divorce, We The People cannot continue with your case because it is no longer uncontested. But you don’t lose what you’ve invested—all documents we’ve prepared are yours to keep, ensuring the work and cost are never wasted.
Why Choose We The People?
At We The People of NY, we make it possible to complete a divorce—even when your spouse won’t cooperate—through a streamlined and cost-effective One Signature Divorce process.
